Delaware Adopts Hazardous Waste Generator Improvements Rule

Delaware is the latest state to adopt the Hazardous Waste Generator Improvements Rule (HWGIR). “The First State” joins 33 additional states and the U.S. territory of Puerto Rico in adopting the rule, which will go into effect on Jan. 21, 2021. As we kick off the New Year, there continues to be progress in the remaining states moving toward the adoption of the HWGIR.

The following states have anticipated rulemaking after July 1, 2021:

  • Minnesota, Missouri, New York and Texas (first half of 2021 public comment)
  • Connecticut, Kansas, Montana, Nebraska and Oregon (second half of 2021 public comment)

Tennessee expects rulemaking by July 1, 2021 as do Washington, D.C. and Maryland, which will have public comment in the first half of 2021.

The HWGIR streamlines and restructures the hazardous waste regulations to make them more comprehensible for the regulated community. This new structure aims to provide the regulated community with an enhanced understanding of the Resource Conservation and Recovery Act (RCRA) hazardous waste generator program and to improve regulatory compliance. The rule also includes changes that are meant to address existing gaps in hazardous waste regulations, ultimately strengthening protections for human health and the environment.
