Hazardous Waste Generator Improvement Rule to Go Into Effect in Maine in 2024
The Hazardous Waste Generator Improvement Rule, published in 2016, includes more than 60 changes to how hazardous waste is handled. Specifically, it addresses gaps in existing regulations to strengthen environmental protection while also providing greater flexibility for generators to manage waste cost-effectively.

State Updates
California: The final rule went into effect on July 1, 2024.
Connecticut: The rule is currently being drafted with the intent to partially adopt. The proposed rule, along with hearing dates, comment periods and meeting notices, is expected to be published in 2024 or 2025. The final rule is set to go into effect in 2025 or 2026.
Kansas: The rule is currently being drafted per BWM Policy 2017-P2. The proposed rule, along with hearing dates, comment periods and meeting notices, is set to be published in Winter 2024 or Spring 2025. The final rule is expected to go into effect in 2025 or 2026. In 2022, Kansas signed a policy on August 2, 2017, identifying the less stringent provisions being implemented before adopting the rule.
Maine: The rule being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in September 2024. The final rule is anticipated to go into effect in Fall 2024.
Missouri: The state held a public hearing on September 19, 2024, for the proposed rule. The rule is now in a public comment period, with the final rule set to go into effect on February 18, 2025.
Rhode Island: The rule is undergoing internal discussions. The rule is set to be published in Fall 2024, followed by a comment period. The final rule is set to go into effect in 2025.
Anticipated Rulemaking in 2024
New Hampshire: The rule will be issued in two parts. Part 1, Env-Hw300-800, 110, 1200, is complete. Part 2 is undergoing internal discussions. The proposed rule, along with hearing dates, comment periods and meeting notices, is set to be published in the summer of 2024. The final rule is set to go into effect in the fall of 2024.

Massachusetts: The rule is undergoing internal discussions. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in Summer or Fall 2024. The final rule is set to go into effect in 2025.
Missouri: The rule is being drafted. The proposed rule is set to be published on August 15, 2024. Currently, the comment period is expected to occur in 2024. The final rule is set to go into effect on February 18, 2025.
