More States Adopt Hazardous Waste Generator Improvements Rule

As states and territories continue to analyze the Hazardous Waste Generator Improvements Rule, we are continuing to monitor their latest rulemaking activity.

Below is the most recent anticipated schedule of states and territories adopting the Hazardous Waste Generator Improvements Rule:

  • Where the Rule is in Effect: Alabama, Alaska, Colorado, Florida, Georgia, Idaho, Iowa, Kentucky, Mississippi, New Jersey, North Carolina, Pennsylvania, Puerto Rico, Utah, Virginia and West Virginia
  • Anticipated Rulemaking by September 2018: Hawaii and Illinois
  • Anticipated Rulemaking by Late Summer or Fall 2018: Delaware, Illinois, Kansas, Maryland, Massachusetts, Missouri and Vermont
  • Anticipated Rulemaking by July 2019: Arizona, Indiana, Michigan, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New York, Ohio, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee and Texas
  • Not Yet Determined: Arkansas, California, Connecticut, Maine, North Dakota and Washington, D.C

Additionally, Michigan and Washington anticipate a draft rule published in September followed by a comment period. Oklahoma’s final rule is pending legislative review and anticipates a final rule to be published in September.
