More States Closer to Adopting Hazardous Waste Generator Improvements Rule

As states and territories continue to analyze the Hazardous Waste Generator Improvements Rule, we are continuing to monitor the latest rulemaking activity.

Below is the most recent anticipated schedule of states and territories adopting the Hazardous Waste Generator Improvements Rule:

  • States Where the Rule is in Effect: Alabama, Alaska, Colorado, Florida, Georgia, Hawaii, Idaho, Iowa, Kentucky, Mississippi, New Jersey, North Carolina, Oklahoma, Pennsylvania, Puerto Rico, Utah, Virginia and West Virginia
  • Anticipated Rulemaking by late 2018/winter 2019: Arizona, Delaware, Illinois, Maryland, Rhode Island, South Carolina and Washington
  • Anticipated Rulemaking in 2019: Indiana, Kansas, Massachusetts, Michigan, Minnesota, Montana, Nebraska, Nevada, New Hampshire, South Dakota, Tennessee, Vermont and Wyoming
  • Not Yet Determined: Arkansas, California, Connecticut, Maine, Missouri, North Dakota, New York, Texas and Washington, D.C.

Michigan’s proposed rule is currently in its 30-day comment period with a final rule expected by Jan. 15, 2019. Additionally, we anticipate Indiana’s final rule by March 2019.
