Missouri and Nevada Make Progress on Aerosols as Universal Waste Final Rule Adoption

The Environmental Protection Agency began regulating aerosol cans as universal waste in 2020, responding to the increasing quantity of cans produced yearly. The Aerosols as Universal Waste rule provides less complicated requirements to promote recycling and has been widely adopted across the United States.

As states implement the rule, Clean Earth monitors timelines and statuses to keep our customers informed.

State Updates

Connecticut: The rule is currently being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in 2024 or 2025. The final rule is set to go into effect in 2025 or 2026.

Kansas: The rule is currently being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in Winter 2024 or Spring 2025. The final rule is set to go into effect in 2025 or 2026.

Maine: The rule is currently being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in September 2024. The final rule is set to go into effect in Fall 2024.

Missouri: The state held a public comment period on September 19, 2024. The proposed rule is now in a public comment period, with the final rule set to go into effect on February 18, 2025.

Nevada: The rule is currently being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in Fall 2024. The final rule is expected to go into effect in Fall 2024.

Rhode Island: The rule is undergoing internal discussions. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in Fall 2024. The final rule is expected to go into effect in 2025.

Anticipated Rulemaking in 2024

Maryland: The rule is currently being drafted. The proposed rule is set to be published in June 2024. The hearing dates, comment periods, and meeting notices are anticipated in Summer 2024. The final rule is set to go into effect in Summer 2024.

Anticipated Rulemaking in 2025

Wisconsin: The rule is in a post-public comment period. The proposed rule is set to be published in Spring 2024. A public hearing is scheduled for May 2024. The final rule is expected to go into effect in Summer 2025.
