Aerosols as Universal Waste Final Rule Goes into Effect in Massachusetts
The Environmental Protection Agency began regulating aerosol cans as universal waste in response to the increasing quantity of cans produced each year. The Aerosols as Universal Waste rule provides streamlined regulations to promote recycling and has been widely adopted across the United States.
Most recently, the Aerosols as Universal Waste Rule has been enacted in Massachusetts.

Massachusetts: The rulemaking is complete, and the final rule went into effect on May 24, 2024.
Anticipated Rulemaking in 2024
Maine: The rule is currently being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in June 2024. The final rule is set to go into effect in September 2024.
Maryland: The rule is currently being drafted. The proposed rule is set to be published in June 2024. The hearing dates, comment periods, and meeting notices are anticipated in the summer of 2024. The final rule is set to go into effect in the summer of 2024.
Nevada: The rule is undergoing internal discussions. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in 2024. The final rule is expected to go into effect in 2024.
Anticipated Rulemaking in 2025
Connecticut: The rule is currently being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in 2024. The final rule is set to go into effect in 2025.
Kansas: The rule is currently being drafted. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in 2024. The final rule is set to go into effect in 2025 or 2026.
Missouri: The rule is currently being drafted. The proposed rule is expected to be published on August 15, 2024. The comment period is expected to occur in the fall of 2024. The final rule is set to go into effect on February 18, 2025.
Rhode Island: The rule is undergoing internal discussions. The proposed rule, hearing dates, comment periods and meeting notices are expected to be published in the summer of 2024. The final rule is expected to go into effect in 2025.
Wisconsin: The rule is in a post-public comment period. The proposed rule is set to be published in the spring of 2024. A public hearing is scheduled for May 2024. The final rule is expected to go into effect in the summer of 2025.
