Hazardous Waste Generator Improvements Rule in Effect in Maryland

The Environmental Protection Agency’s (EPA) Hazardous Waste Generator Improvements Rule (HWGIR) provides a needed update to the hazardous waste generator regulations with the goal of simplifying hazardous waste management by allowing greater flexibility in how entities dispose of hazardous waste.
As more states work toward putting the Final Rule into effect, Clean Earth is tracking the status of rulemaking, including timelines for public comment and adoption.
Maryland: Rulemaking is complete, and the final rule went into effect on May 3, 2021.
Minnesota: Currently drafting the rule and adding it to a previously proposed rulemaking: Land-Related Housekeeping Amendments. Public hearing dates and comment periods will be in September 2021 with the final rule expected to go into effect in 2022.
Missouri: Currently drafting the rule with anticipated rulemaking after July 1, 2021. Public comment in summer 2021 with stakeholder meetings on May 13, 2021.
Montana: The rule is currently under internal discussions with intent to adopt by reference. The final rule is expected to go into effect in late spring 2022.
New York: Currently drafting the rule (Federal Register 6). Written comments are being accepted until further notice and the formal public comment period is in spring 2021. Final rule expected to go into effect in 2022.
Vermont: Currently drafting the rule with it expected to go into effect in summer 2021. Public hearing and comment in spring 2021.
