Oregon to Adopt HWGIR by End of Year

With decades of experience implementing the hazardous waste generator regulatory program and working with states and other stakeholders, the United States Environmental Protection Agency (EPA) noticed inconsistencies and a lack of flexibility in the regulations. In response, the EPA’s final Hazardous Waste Generator Rule was put into effect, providing needed flexibility, improvements of environmental protection and the addressing of gaps in existing regulations.

To maintain compliance with the final rule, hazardous waste generators are encouraged to monitor each state’s progress as they work toward adopting the rule.

State updates since last month include:

Not yet determined

• California: Drafted rule was withdrawn and revised resubmittal is expected January 2022. The final rule is to go into effect in 2022.

Anticipated rulemaking by December 2021

• Oregon: Rule drafting is complete and pending an effective date. Following the approval, the Committee Meeting took place November 17, 2021. The final rule is to go into effect January 1, 2021.

Anticipated rulemaking after December 2021

• Kansas: Proposed rule is to be published early 2022. Public hearings, comment periods and meeting notices are set for 2022 with an informal request for feedback in the first half of the year. The final rule is to go into effect in 2023.
• Missouri: The drafted rule is in the Stakeholder Review Period. The proposed rule is to be published early 2022 along with public hearings, comment periods and meeting notices. Final rule is to go into effect in 2023.
• Montana: Currently drafting the formal rule which is to be published in January or February 2022. Formal public hearings, comment periods and meeting notices have a tentative date of February 9, 2022.
• Texas: Anticipated publication of the final rule is set for January 28, 2022, and will go into effect February 3, 2022.
• Vermont: The proposed rule is under legislative review with a meeting to be held December 23, 2021. Final rule is to go into effect late January/early February 2022.
• Washington, D.C.: Proposed rule is to be published early 2022. Public hearings, comment periods and meeting notices are to be held in early 2022 with comments accepted for 30 days following publication. The final rule is to go into effect early 2022.

The anticipated rule will be partially effective in 2022 in the following:

• Kansas
• Washington, D.C.
• Missouri
• Montana
