Washington D.C. and Montana soon to adopt Hazardous Waste Generator Improvement Rule

First put into effect in 1980 by the U.S. Environmental Protection Agency (EPA), the Hazardous Waste Generator Improvement Rule consists of 60 changes that allow for flexibility in how hazardous waste is managed and categorized in the U.S. Furthermore, this rule helps to provide clarity surrounding the regulations and in turn dictates compliance.

The rule has been adopted state-by-state, so it’s crucial that hazardous waste generators stay in the know on the effective dates in each state. Clean Earth provides a monthly update of the rules progress by state:

Anticipated Rulemaking by July 1, 2022

  • Washington D.C.: The rule is in the post public comment period (adopting by reference). The comment period was extended to March 7, 2022. The rule is to go into effect late April 2022.
  • Montana: The rule is in the post public comment period (adopting by reference). The public meeting was held February 9, 2022. The rule is to go into effect May 14, 2022.

Anticipated Rulemaking after July 1, 2022

  • California: The rulemaking is currently being drafted (non-substantive rulemaking inapplicable). The proposed publish date is November 2022. The public hearing will be held December 2022 or January 2023, and comments are also due at this time. The rule is to go into effect early 2023. 
  • Maine: The rulemaking is currently undergoing internal discussions. The proposed publish date as well as the public hearing dates, comment periods and meeting notices are set for Fall 2022. The rule is to go into effect in 2023.
  • Minnesota: The rule is currently being drafted and will be added to the previously proposed rulemaking: Land-Related Housekeeping Amendments. The proposed publish date, along with the public hearing dates, comment periods and meeting notices is August 2022. The rule is to go into effect in 2022.
  • New Hampshire: The rulemaking for Part 2 is undergoing internal discussions. The proposed publish date as well as the public hearing dates, comment periods and meeting notices are scheduled for 2023. Part 2 of this rule is to go into effect in late 2023.
