Mississippi to Adopt Aerosols as Universal Waste Rule on July 1

In late 2019, the Environmental Protection Agency finalized regulations that allow for aerosol cans to be managed as universal waste under the Resource Conservation and Recovery Act (RCRA). This rule change impacts a wide variety of establishments generating and managing aerosol cans.

Clean Earth is tracking the rulemaking process to provide states with updates on when the rule is effective, as well as when to expect the interim steps such as draft regulations and public comment periods. The rule was most recently adopted in Montana and Wyoming.

Anticipated rulemaking by July 1, 2022

• Mississippi: The rulemaking is complete, and the rule is to go into effect on July 1, 2022.

Anticipated rulemaking after July 1, 2022

• Arkansas: The rule is currently being drafted and is undergoing internal review. The proposed publish date along with the public hearing dates, comment periods and meeting notices are scheduled for late summer, 2022. The rule is to go into effect in fall 2022.
• Maryland: The rule is undergoing internal discussions. The proposed publish date, public hearing dates, comment periods and meeting notices are scheduled for summer 2022. The rule is to go into effect in summer or fall 2022.
• Massachusetts: The rule is currently being drafted. The proposed publish date, public hearing dates, comment periods and meeting notices are scheduled for 2022. The rule is to go into effect in 2022.
• New Hampshire: The rule is in the post public comment period and is to go into effect late July 2022.
• Ohio: The rule is in the informal public comment period (aligning existing law with Federal law). The revised regulation is to go into effect late summer 2022.
