Massachusetts to Adopt Aerosols as Universal Waste Rule in Summer 2023
In 2019, the Environmental Protection Agency finalized regulations that added aerosols to the federal universal waste list. This change made it easier for businesses and consumers to recycle aerosol cans and helped to reduce the amount of hazardous waste that goes to landfills.

Anticipated Rulemaking in 2023:
Massachusetts: The rule is currently in the post public comment period. The proposed rule was published on January 4, 2023. Public hearing took place from January 30, 2023, to February 3, 2023, with the comment period ending on January 17, 2023. The final rule is set to go into effect in Summer 2023.
Anticipated Rulemaking in 2024:
Kansas: The rule is currently being drafted. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in Fall 2023. The final rule is set to go into effect in 2024.
Nebraska: The rule is currently in the internal discussions period. The proposed publish date, public hearing dates, comment periods and meeting notices are not yet determined. The final rule is set to go into effect in 2024.
