Discussion on Reclassification of Products with Low Levels of Nicotine at EPA Hearing

The National Association of Chain Drug Stores and RILA asked the EPA to reclassify products with low levels of nicotine during a public meeting held May 9, 2017 by the EPA’s Office of Land and Emergency Management.
While testifying individually, both organizations asked the EPA to reclassify nicotine products as non-acutely hazardous wastes, noting that consumers can dispose of low-concentration nicotine products such as nicotine gum, lozenges, patches, prescription liquids and e-cigarettes.
However, nicotine is currently classified as an acutely hazardous waste under RCRA, which means the disposal of the same products are highly regulated in a retail store setting. To read RILA’s comments in their entirety, click here.
