Generator Improvements Rule: 28 States Pending Adoption

With Washington’s rule effective last month, 28 states are left pending adoption of the Hazardous Waste Generator Improvements Rule.

As states and territories analyze the rule, Clean Earth continues to monitor the latest activity. Below, we outline the most recent anticipated schedule of states and territories adopting the rule.

States Where the Rule is in Effect

Alabama, Alaska, Arizona, Colorado, Florida, Georgia, Hawaii, Idaho, Illinois, Iowa, Kentucky, Mississippi, New Jersey, New Mexico, North Carolina, Oklahoma, Pennsylvania, Puerto Rico, Utah, Virginia, Washington and West Virginia

Anticipated Rulemaking in 2019

Connecticut, Delaware, Indiana, Kansas, Maryland, Michigan, Massachusetts, Minnesota, Montana, Nebraska, Nevada, New Hampshire, Rhode Island, South Carolina, South Dakota, Tennessee, Vermont, Wisconsin and Wyoming

Not Yet Determined

Arkansas, California, Maine, Missouri, North Dakota, New York, Texas and Washington, D.C.

Washington state’s effective date was April 28, and Wisconsin’s public comment period closed May 9. Wyoming’s final rules are under executive review.
