Oregon, Vermont Set to Adopt HWGIR by December

States are continuously working toward adapting the final Hazardous Waste Generator Improvement Rule in order to reach compliance. The final Hazardous Waste Generator Rule was put into effect to provide needed flexibility, improvements of environmental protection and the addressment of gaps in existing regulations.

To maintain compliance with the final rule, hazardous waste generators are encouraged to monitor each state’s progress as they work toward adopting the rule.

The following highlights state progress toward adopting the Hazardous Waste Generator Improvements Rule.

Anticipated rulemaking by December 2021

• Missouri: Currently not adopted or authorized, but the rule is anticipated to go into effect in late 2021.
• Oregon: The rule is in the post public comment period. The committee meeting will be held in November 2021. If the board approves the rule in November, the final rule will go into effect January 1, 2022.
• Vermont: The rule is in the post public comment period. The final rule is to go into effect late 2021.

Anticipated rulemaking after December 2021

• Minnesota: The rule is in a drafting period (adding to previously proposed rulemaking: Land-Related Housekeeping Amendments). The informal rule is to be published in January 2022, along with the public hearing, comment period and meeting notices.
• Montana: The rule is in an informal public comment period (intend to adopt by reference). Informal public comments were due by September 14, 2021, with formal comments to be accepted in 2022.
• Nebraska: The rule is in the internal discussions period. The informal rule is to be published in late 2022, as well as the public hearing, comment period and meeting notices. The final rule is to take effect late 2022.
• New Hampshire: The rule is currently being issued in two parts, with the first part being completed on August 8, 2019. The second part is to conclude in 2022 with the publishing of the proposed rule, public hearing, comment periods and meeting notes. The final rule is to go into effect late 2022.
• Texas: The rule is currently in post public comment period. Intended publication is to be delivered on December 31, 2021 with the final rule to go into effect on January 6, 2022.
