South Dakota Prepares to Adopt Aerosols as Universal Waste Rule

In February 2020, the Environmental Protection Agency (EPA) made an essential addition to the federal universal waste list by including aerosols. This addition provides more transparent guidelines and simplified requirements, resulting in a reduction in regulatory burden faced by retailers, along with a decrease in the volume of aerosols being sent to municipal solid waste landfills and combustors.

Clean Earth actively monitors rulemaking across various states to provide updates on proposed rule publications, public hearings, comment periods, meeting notices, and final rule effective dates. As individual states initiate implementing the rule, Clean Earth is committed to providing updates regarding the status of these rulemaking efforts.

Anticipated Rulemaking in 2023

South Dakota: The rule is under legislative review. Comments were due by 7/17/2023, and a public hearing was held on 7/20/2023. The final rule is set to go into effect in September 2023.

Anticipated Rulemaking in 2024:

Maine: The rule is currently undergoing internal discussions with a proposed publish date, public hearing dates, comment periods and meeting notices scheduled for Spring 2024. The final rule is set to go into effect in September 2024.

Minnesota: The rule is currently being drafted as an addition to the previously proposed rulemaking: Land-Related Housekeeping Amendments. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in December 2023. The final rule is set to go into effect in June 2024 if no hearing is required. If a hearing is necessary, the final rule will go into effect in December 2024.
