California Set to Adopt Hazardous Waste Generator Improvement Rule
The hazardous waste generator regulatory program has governed hazardous waste management since the 1980s. Inconsistencies and a lack of flexibility in the way the regulations were written made them difficult for generators to follow. In response, the Environmental Protection Agency (EPA) created the final Hazardous Waste Generator Rule in 2016, clarifying its provisions and providing needed flexibility for generators.

Anticipated Rulemaking in 2023:
California: The rule is currently in the post public comment period. The proposed rule was published on March 24, 2023 and comments were due May 8, 2023. The final rule is set to go into effect in 2023.
Anticipated Rulemaking in 2024:
Kansas: The rule is currently being drafted in reference to the BWM Policy 2017-P2. The proposed publish date is set for Summer 2023. The public hearing dates, comment periods, and meeting notices will take place in Fall 2023. The final rule will go into effect in 2024.
Minnesota: The rule is currently being drafted and added to previously proposed rulemaking: Land-Related Housekeeping Amendments. The proposed publish date, public hearing dates, comment periods, and meeting notices will take place in August 2023. The final rule is set to go into effect in February 2024 if no hearing is required or in August 2024 if a hearing is required.
Missouri: The rule is currently being drafted and in the stakeholder review period. The proposed publish date, public hearing dates, comment periods, and meeting notices will take place in Summer 2023. The final rule is set to go into effect in early 2024.
