LATEST UPDATE TO THE GENERATOR IMPROVEMENTS RULE

The EPA’s final Hazardous Waste Generator Improvements Rule revises hazardous waste generator regulations by making them easier to understand and providing greater flexibility in how hazardous waste is managed. This includes rules for improvements to environmental protection and labeling of hazardous waste.

It is critical for hazardous waste generators to be aware of where the rule is in effect, when it will come into effect in your state and the impacts to your organization, in order to remain compliant. Specific Updates

California has withdrawn its legislative review to revise and will resubmit with a goal to have a final rule in place by summer 2020. Delaware is currently in it’s public comment period with a rule drafted and its publication pending, with a proposed date of May in 2020. Louisiana is currently in its post public comment period. Maryland  is planning its final Rule effective date for January 2021. Minnesota is proposing August 2020 to have its rule published with public hearing dates in Summer of 2020. Missouri is currently drafting its rule, with a proposed  rule  published in Summer or fall of 2020 with public hearings set that fall and the final rule effective date to occur at the end of 2020. Montana’s rule making it intended to adopt by reference. Nevada is in a Legislative Review, with the State Environmental Commission meeting postponed, the final rule effective date will be set for late 2020/2021. Ohio is panning to have the proposed rule published in Spring or Summer of 2020, with the formal comment period occurring in the same time frame.
