Kansas, Minnesota and Missouri Set to Adopt Hazardous Waste Generator Improvement Rule in 2024

Since the 1980s, the hazardous waste generator regulatory program has governed hazardous waste management. The regulations lacked flexibility and were difficult for waste generators to follow. In 2016, as a long-term solution to this problem, the Environmental Protection Agency (EPA) finalized the Hazardous Waste Generator Improvement Rule to clarify the regulations.

As states look to implement the Hazardous Waste Generator Improvement Rule, Clean Earth provides monthly updates to help hazardous waste generators stay up to date on where the rule is currently in effect.

Anticipated Rulemaking in 2023:

California: The rule is currently in the public comment period. The proposed rule was published on March 24, 2023, with modifications published on July 5, 2023. Comments are due July 20, 2023, with the final rule set to go into effect in fall 2023.  

Anticipated Rulemaking in 2024:

Kansas: The rule is currently being drafted in reference to the BWM Policy 2017-P2. The proposed publish date is set for fall 2023. The public hearing dates, comment periods, and meeting notices will occur in late fall 2023. The final rule will go into effect in summer 2024.  

Minnesota: The rule is currently being drafted and added to previously proposed rulemaking: Land-Related Housekeeping Amendments. The proposed publish date, public hearing dates, comment periods, and meeting notices will occur in November 2023. The final rule is set to go into effect in May 2024 if no hearing is required or in November 2024 if a hearing is required.  

Missouri: The rule is currently being drafted and in the stakeholder review period. The proposed publish date, public hearing dates, comment periods, and meeting notices will occur in fall 2023. The final rule is set to go into effect in early 2024.
