Hazardous Waste Generator Improvements Rule: Timeline of State Adoptions

On October 28, 2016, Environmental Protection Agency Administrator Gina McCarthy signed the final Hazardous Waste Generator Improvements Rule intended to provide more clarity and flexibility to businesses. The final rule includes more than 60 changes to the Hazardous Waste Generator program first introduced in 1980 under the Resource Conservation and Recovery Act (RCRA).
The Hazardous Waste Generator Improvements Rule is scheduled to become effective May 30, 2017. Here is the timeline of state and territory adoptions:
- The rule will become effective that day in states and territories that are not RCRA-authorized
- States with approved programs must adopt more stringent new regulations by July 2018
- States that require legislation to update regulations must adopt the rule by July 2019
Below is the anticipated schedule of states and territories adopting the Hazardous Waste Generator Improvements Rule:
- Effective May 30, 2017: Alaska, Iowa and Puerto Rico
- Reviewing Internally: Arkansas, California, Connecticut, Delaware, Kansas, Louisiana and Vermont
- Rulemaking in Q4 2017: Alaska, Illinois, Maryland, Minnesota, Mississippi, Montana, New York, Pennsylvania and Virginia
- Rulemaking before 2017: Colorado, Hawaii, Idaho, Indiana, Michigan, North Carolina, Oklahoma, Texas, Washington, West Virginia and Wyoming
- Rulemaking before 2018: Nevada, North Dakota, Ohio, Oregon and Tennessee
- First Activity: North Carolina held public hearing April 3, comments were due April 7
- No Activity: Arizona, Florida, Georgia, Kentucky, Maine, Massachusetts, Missouri, Nebraska, New Hampshire, New Jersey, New Mexico, Rhode Island, South Carolina, South Dakota, Utah and Wisconsin
