PHMSA Gives Notice of International Enforcement Policy

The Pipeline and Hazardous Materials Safety Administration (PHMSA) recently announced its international enforcement policy, which says the organization won’t take enforcement action against any carrier using the newly adopted International Civil Aviation Organization (ICAO) standards when transporting hazardous materials by certain modes.
The announcement comes after the understanding that many carriers transporting hazardous waste internationally will soon be adhering to requirements in the newly adopted 2019-2020 Edition of the ICAO’s Technical Instructions for the Safe Transport of Dangerous Goods by Air and Amendment 39-18 of the International Maritime Organization, International Maritime Dangerous Goods Code (IMDG Code).
While PHMSA determines whether to adopt the ICAO Technical Instructions and Amendment 39-18 of the IMDG Code, the organization will not take enforcement action against any carrier using these standards.
Additionally, PHMSA won’t take action against any carrier that offers or accepts packages labeled in accordance with these standards. Please click here to read the full notice.
