West Virginia Adopts Hazardous Waste Generator Improvements Rule

As states and territories continue to analyze the Hazardous Waste Generator Improvements Rule, we are continuing to monitor their latest rulemaking activity. West Virginia became the latest state to put the rule into effect as of June 1, 2018.

Below is the most recent anticipated schedule of states and territories adopting the Hazardous Waste Generator Improvements Rule:

  • Where the Rule is in Effect: Alabama, Alaska, Georgia, Iowa, Idaho, Kentucky, New Jersey, North Carolina, Pennsylvania, Puerto Rico, Utah, Virginia and West Virginia
  • Anticipated Rulemaking by June 2018: Mississippi
  • Anticipated Rulemaking by July 2018: Colorado, Delaware, Florida, Hawaii, Illinois, Kansas, Massachusetts, Maryland, Missouri and Vermont
  • Anticipated Rulemaking by Fall 2018: New Mexico and Oklahoma
  • Anticipated Rulemaking by July 2019: Arizona, Indiana, Ohio, Oregon, Michigan, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New York, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Washington and Wisconsin
  • Not Yet Determined: Arkansas, California, Connecticut, District of Columbia, Louisiana, Maine and North Dakota
