Washington D.C. Soon to Adopt Hazardous Waste Generator Improvement Rule
Since the 2015 update to the EPA’s Hazardous Waste Generator Improvement Rule, most states and territories have adopted its provisions. The rule closes gaps in existing regulations to provide generators with flexibility and peace of mind that they are complying with EPA regulations.
To ensure hazardous waste generators remain compliant with existing rules, Clean Earth is tracking legislative implementation as additional states adopt the rule.
Anticipated Rulemaking Before January 2023
Washington D.C.: The rule is currently undergoing legislative review (adopting by reference). The rule is to go into effect in fall 2022.
Anticipated Rulemaking After January 2023
Minnesota: The rule is being drafted, adding to the previously proposed rulemaking. The proposed publish date, public hearing dates, comment periods and meeting notices are scheduled for February 2023. The rule is to go into effect in 2023.
Missouri: The rule is being drafted and is currently in the stakeholder review process. The proposed publish date, public hearing dates, comment periods and meeting notices are scheduled for late fall 2022. The rule is to go into effect in late 2023.
Nebraska: The rule is undergoing internal discussions. The proposed publish date, public hearing dates, comment periods and meeting notices are scheduled for fall 2023. The rule is to go into effect in 2024.
