Hazardous Waste Generator Improvements Rule in Effect in Louisiana, Michigan

With decades of experience implementing the hazardous waste generator regulatory program and working with states and other stakeholders, the U.S. Environmental Protection Agency (EPA) noticed inconsistencies and a lack of flexibility in the regulations. In response, the EPA’s final Hazardous Waste Generator Rule was put into effect, providing needed flexibility, improvements of environmental protection and the addressment of gaps in existing regulations.

To maintain compliance with the final rule, hazardous waste generators are encouraged to monitor each state’s progress as they work toward adopting the rule.

State Updates

Louisiana and Michigan are the most recent states to adopt the rule.

The below states have anticipated rulemaking by Dec. 31, 2020:

• Nebraska (public comment period open in the second half of 2020)
• Tennessee

The below states have anticipated rulemaking after Dec. 31, 2020, with public comment period in the second half of 2020:

• Delaware
• Maryland
• Missouri
• Ohio
• Oregon
• Texas
